A gradual injury, also known as a Continuous Trauma injury, occurs over a period of time. It may be a short period of time or a long period of time depending upon the exposure or the activity that is causing your symptoms.

Exposure to working conditions or repetitive activities gradually causes physical, internal, and/or emotional pain or other symptoms. You may have initial symptoms that you hardly notice or ignore them expecting them to subside. Often, they do subside for awhile, and then gradually these symptoms begin to worsen and begin to interfere with your ability to perform your work duties and activities of daily living. You may have already sought medical attention, received some treatment, and returned to your regular duties.

In some situations, a worker may suffer a workers compensation injury while at the same time suffering a civil injury lawsuit.

If the injury was caused by the negligence of a third party, then the injured worker may have a civil negligence lawsuit as well as a workers compensation case.

There are innumerable situations in which an injured worker may have a workers compensation case and have a civil third party liability case.

Some common situations include a person involved in an automobile accident while working, sexual harassment, falling from scaffolding constructed by a company and not the injured worker's co-workers, and a machine malfunctioning.
